Who Gets to Set the Speed Limit—and What the Number Really Measures

Before 55 mph, the Sign Belonged to the Road

A speed-limit sign looks like a simple instruction: a number, a unit, and the expectation that drivers will obey. Historically, however, the number has also identified who possesses the authority to regulate movement on a road. Before the federal government imposed a national ceiling, speed limits were set by individual states and varied across the country from roughly 40 to 80 miles per hour. The sign therefore belonged to the jurisdiction responsible for the road and to the local judgment that translated traffic conditions into an enforceable rule.
New York offers a revealing example of what that local system required. In 1925, the state legislature required cities to place conspicuous signs wherever the rate of speed changed on a main highway, and it required those signs to be adequately illuminated between sunset and sunrise. The rule treated visibility as part of enforcement: a limit could not effectively govern drivers if drivers could not see where it began or ended. The practical difficulty of illuminating the many signs needed across towns and cities encouraged the use of reflective “cats-eye” signs, whose reflectors returned the light of early automobile headlights to the driver.
That administrative problem captures the older meaning of a speed limit. It was a locally posted instruction, dependent on the road, the jurisdiction, and the ability to communicate a change to people using it. The national highway system could still contain a patchwork of numbers because no single federal maximum controlled them all. Yet the sign’s later history would make it the instrument of a much larger question: if speed limits could be changed locally and made visible through local administration, how did one number come to govern highways across the country?
And when that national command eventually loosened, what did the number measure: a judgment about safety, an effort to conserve fuel, the speed drivers already chose, or the political authority of the government placing the sign?
The Oil Crisis Turned 55 mph into Federal Policy

The transformation began with an emergency that Congress and the White House treated as a national problem rather than a collection of local traffic questions. On January 2, 1974, President Richard Nixon signed the Emergency Highway Energy Conservation Act in response to the oil embargo. The law imposed a national maximum speed of 55 miles per hour. Its stated policy logic was energy conservation: slower driving was expected to improve fuel efficiency and reduce the country’s dependence on foreign oil. A rule previously represented through varied state and local decisions was now expressed as one nationwide ceiling.
The federal government did not need to administer every traffic stop to make that ceiling effective. Instead, the law connected compliance to the federal highway program. The Department of Transportation could not approve or fund highway projects in states that failed to comply with the 55-mph limit. Federal spending power became the enforcement mechanism. States retained responsibility for traffic enforcement on their own roads, but access to highway-project approval and funding was conditioned on accepting the national number. The result was a federal command carried out through state administration.
The policy’s first-year safety record made its meaning more complicated. Reported fatalities fell from 55,511 in 1973 to 46,402 in 1974, a decline of 16 percent cited in a National Research Council report. The figures coincided with the first year of the 55-mph policy, but the coincidence does not by itself prove that the lower speed limit was the sole cause of the decline. It did, however, give the intervention a powerful second justification. A measure adopted to conserve fuel could also be defended as a measure associated with fewer deaths on the road.
That association mattered politically. The 55-mph rule was framed around fuel conservation, yet the striking early fatality figures helped make it harder to evaluate only as an energy policy. Its defenders could point to safety as well as fuel use, while its opponents confronted a rule whose consequences appeared to extend beyond the oil crisis that had produced it. Congress made the limit permanent in 1975. The sign had consequently acquired a new institutional meaning: 55 mph was no longer merely a number selected by a state or locality, but the visible expression of federal leverage over the nation’s highway system.
In 1987, States Were Allowed to Move the Number Up

The next change was not a return to the old patchwork. Congress opened a narrow door for states to choose a higher limit while keeping the federal framework in place.
The Surface Transportation and Uniform Relocation Assistance Act of 1987 authorized states to raise limits to 65 miles per hour on qualifying rural Interstate segments outside urbanized areas of 50,000 or more people. The permission applied to particular stretches of the Interstate system, not to every road or state route. Federal law still defined the boundaries of the choice; state officials could exercise judgment only within them.
Virginia shows how that permission became an administrative decision. Its 65-mph rural-Interstate limit took effect for passenger cars on July 1, 1988, and for commercial buses on July 1, 1989. A Virginia transportation report then summarized 18 months of experience with the higher limit. Congress had authorized the option, but Virginia determined whether and how the higher number would appear on qualifying roads.
That distinction shifted the debate. Once states could raise the limit, the question became what should justify a choice between 55 and 65 miles per hour. Officials could consider the roadway, the way drivers used it, and the consequences associated with different speeds. Those considerations brought traffic engineering into the process without removing political judgment. A measured pattern of driver behavior might support one number; a safety record or public demand might support another.
The 1987 law therefore restored some state discretion without ending federal control. It also created the need for a more specific rationale: how could an observed traffic speed become a legal limit?
The 85th Percentile: When Driver Behavior Sets the Benchmark

One influential answer is the 85th-percentile method. Engineers measure free-flowing vehicles and identify the speed at or below which 85 percent of those drivers travel. Texas describes its highway speed-zone studies this way, then rounds the result to the nearest value ending in 5 or 0. The method offers a straightforward bridge between behavior and law: an agency can justify a posted limit by pointing to the speed at which most drivers are already traveling.
Three ideas, however, remain distinct. Design speed concerns the geometric and functional characteristics a road is built to accommodate. Operating speed describes what drivers actually do there. Posted speed is the enforceable legal ceiling displayed on the sign. Road design can influence operating speeds; operating speeds can determine the 85th-percentile calculation; and an agency can use that calculation when choosing the posted limit. The legal number is therefore not a direct reading of the road’s physical design, but a decision based partly on observed behavior.
That distinction creates a feedback problem. If a roadway’s design and surroundings encourage drivers to travel quickly, measuring those speeds can turn behavior produced by the existing environment into the benchmark for a new legal limit. Los Angeles’s 2017 citywide updates show the consequence. Reliance on the 85th percentile increased limits on 90 miles of roads, including several with histories of serious or fatal crashes. The measurement supplied a rationale for raising the limit, while the crash histories raised a separate question: was prevailing speed enough evidence on its own?
Portland and Seattle show that the method does not dictate one inevitable result. Both cities used more flexible approaches that incorporated crash statistics and road type. Unlike Los Angeles in 2017, those methods did not produce speed-limit increases. The difference lay not simply in whether officials measured traffic, but in which evidence they allowed to shape the decision.
The 85th percentile can therefore work in two directions. It can require officials to confront observed conditions, but it can also lend technical legitimacy to speeds a roadway already produces. The measurement identifies a distribution of driver behavior; the agency decides what that distribution means, and what weight to give road type and crash history. As state discretion broadened, the method became more important without making the posted limit apolitical.
The 1995 Repeal Made the Sign a State Decision Again

The decisive legal shift came in 1995. The National Highway System Designation Act repealed the remaining federal 65/55-mph maximum-speed restrictions. This was more than another adjustment to the number printed on highway signs. It removed the nationwide ceiling that had continued to structure state decisions even after the 1987 rural-Interstate option. Broad speed-limit authority returned to the states.
The sequence matters. In 1987, Congress had allowed a higher number only on qualifying rural Interstate segments and only within a federal framework. In 1995, Congress eliminated the remaining federal maximum-speed restrictions. The earlier law had made decentralization conditional; the later law made state authority the governing structure. A speed-limit sign on an Interstate no longer represented a state choice bounded by a national 65/55-mph rule. It represented the maximum selected under the law of the state responsible for that segment.
That change did not settle the underlying argument about what the number should be. It changed the institution that had to settle it. States could weigh roadway conditions, observed operating speeds, engineering practice, safety records, and political priorities within their own systems. The federal government no longer supplied one maximum for the national highway system through the same nationwide funding leverage. The sign became more locally variable again, but its apparent simplicity concealed a complex decision: a legal rule could be grounded in measurement, shaped by roadway design, defended through safety claims, or altered in response to political pressure.
The 1995 repeal therefore completed the movement away from federal command while leaving open the technical and political disputes that had always accompanied speed regulation. The question was no longer whether one national number would govern. It was how different states would use their restored authority—and whether their posted limits would follow driver behavior, challenge it, or compromise among evidence and public judgment.
One Sign, Many Judgments

After the repeal, states did not converge on one replacement for the federal number. They responded differently: some raised rural-Interstate limits to historic highs, while others retained limits of 60 or 65 miles per hour. The result was not a final victory for either slower or faster roads. It was a decentralized system in which the same class of highway could carry different legal judgments in different states.
That outcome answers why the number moved from local judgment to federal command and back. Local and state variation initially reflected the authority of the jurisdictions that posted and enforced their own rules. The oil crisis gave Washington a national objective and a means of compelling compliance by tying the 55-mph ceiling to highway-project approval and funding. The 1987 law reopened a narrow space for state choice without ending federal control. The 1995 repeal then removed the remaining national caps and returned broad authority to the states.
What changed when authority changed was the meaning of the sign. Under the 1974 system, 55 mph measured a federal response to fuel insecurity, even though states carried out enforcement and the policy became associated with a sharp first-year decline in reported fatalities. Under the later state-centered system, the number could be justified through engineering evidence such as the 85th percentile, which describes the speed of most free-flowing drivers. Yet that benchmark does not decide the policy by itself. As the contrasting experiences of Los Angeles, Portland, and Seattle show, agencies can give different weight to crash histories, road type, and prevailing speed.
The modern speed-limit sign is therefore three things at once: a legal rule, an engineering judgment, and a political choice. The 85th percentile can inform judgment, but it can also ratify the speeds a roadway already produces. State authority can permit local adaptation, but it can also produce sharply different outcomes. The history is consequently not a steady march toward stricter limits or faster roads. It is a repeated transfer of decision-making power—from local governments, to Washington’s fuel-and-funding leverage, and back to the states—while the number on the sign continues to measure both how a road is used and who has the authority to define what that use should mean.
